Should A Mother Lose Her Children In A Custody Battle Because She Has Cancer?

Alaina Giordano  lost custody of her children because she has stage 4 breast cancer. I may not sleep tonight because instead of seeing pink, I’m seeing red.

According to ABC News, the judge who heard the case cited the forensic psychologist Dr. Helen Brantley:

“The more contact [the children] have with the non-ill parent, the better they do. They divide their world into the cancer world and a free of cancer world. Children want a normal childhood, and it is not normal with an ill parent.”

After I read this I couldn’t help but wonder if the judge and the psychologist had children. If so, how would they feel if they were sick and someone took their children away from them?

Not only is this mom losing custody of her children but her ex-husband just moved from North Carolina (where she lives) to Chicago. She can either leave her doctors, her family and support system and home and move to Chicago, or travel back and forth. Both choices stink.

No woman should have to go through what Alaina Giordano is going through.

  1. I have cancer and yes it has been hard on my kids. But it would be so much harder on them if they knew I was alive but they weren’t able to see my everyday, that would not be a normal childhood.
    Also I had a friend with stage 4 breast cancer and she was able to adopt a baby even though the courts knew…and she did die from the cancer and her husband and parents now take care of the baby. This case is just crazy.

  3. This is so cruel! Prayers for not only this Mom and children, but also the judge, psychologist, and others involved. Some things I will never understand….not sure I want to understand such a decision as this.

  4. Yikes! Once again a woman gets the second class citizen treatment. I can’t imagine a man getting that decision handed to him. Does this ‘doctor’ not think that removing the children from her might have a worse effect than the cancer does?
    If we start taking legal rights away from people with cancer, then society deems them as a pariah. Cancer catches up with all of us. That judge and doctor better watch their backs when it happens to them and hope that no one tries to do to them what they just did to this mother.
